How Can I Prove I'm Eligible for Social Security Disability Benefits?

First, you need to understand that you don’t need to be bedridden to be approved for benefits. The standard is whether your condition makes it so you can’t perform substantial gainful activity. Put simply, you should be prepared to prove that you can’t perform even the easiest, low-skilled jobs. However, just because you can’t perform tasks necessary for your occupation doesn’t mean that you’ll qualify for Social Security Disability benefits.

Second, the older you are, the easier it is to get approved for Social Security Disability. For those who cannot read English, it’s easier at age 45; for others, age 50. And it’s easier yet if you’re over the age of 55. If you’re over 55 and can’t perform the jobs you’ve done in the past 15 years, you should most definitely apply for disability benefits. And, if you’re over 50 and your impairment is so severe that you can’t do jobs other than the very easiest, you should still apply. Also, if you’re under the age of 50 and can’t perform your previous duties or work full-time at any job, you should apply.

Third, understand that just because you can’t work doesn’t mean you’ll be found “disabled” by the Social Security Administration. Being unable to work and being “disabled are two different things, and it can be difficult to convince the Social Security Administration that you are “disabled,” even if you can’t work. For this reason, you need to hire an experienced attorney who is familiar with Social Security disability law. Retaining a knowledgeable legal professional can mean the difference between getting approved and being denied benefits.

Fourth, denials are common – very common. Make sure to appeal the denials at least until you have a hearing held by the administration law judge. And, if you lose at that stage, you may want to hire a lawyer who knows how to navigate the appeals process and represent your interests before the Appeals Council.
